For real estate investors, the December 31st deadline for completing a 1031 exchange is make-or-break. Fail to meet the timelines, and you'll owe capital gains taxes on your entire profit. But nail the strategy, and you can defer taxes indefinitely while building wealth.

The 1031 Exchange Timeline: Know Your Deadlines

A 1031 exchange (named after IRS Section 1031) allows you to sell an investment property and reinvest the proceeds into a like-kind property without paying capital gains tax immediately.

The IRS enforces two strict deadlines:

  • 45-day identification period: You have 45 calendar days from the sale of your property to identify replacement properties.
  • 180-day exchange deadline: You have 180 calendar days total to complete the purchase of your replacement property.

If your property closes December 15, 2026, your deadlines are:

  • Identification deadline: January 29, 2027
  • Exchange completion deadline: June 13, 2027

The 45-Day Identification Window

  • Rule of Three: You can identify up to 3 properties without restriction.

  • Rule of 95%: You can identify any number of properties, but must close on at least 95% of the identified value.
